Contracts for the sale of products with Fantastic Optik.com, the online sales portal owned by Fantastic Optik Srl based in Via Tiburina Valeria Km. 68,800 – 67061 Carsoli (AQ) Italy, are exclusively governed by these general terms and conditions.
These general terms and conditions of contract exclusively regulate the sales contracts stipulated by customers, whether they are natural or legal persons, and Fantastic Optik Srl, with registered office Via Tiburina Valeria Km. 68,800 – 67061 Carsoli (AQ) Italy, VAT number 01349360667. The purchase order made by those who have not completed eighteen years of age is considered without effect.
3) Conclusion of the contract and acceptance of the general terms and conditions
The sales contracts are considered concluded at the time when Fantastic Optik Srl receives payment crediting. Fantastic Optik will promptly send the purchase invoice to the customer. The Customer, by sending his / her order, declares to have read and accepted these general conditions of contract and undertakes to observe and respect them in its relations with Fantastic Optik Srl
Before sending the purchase order, the customer must carefully read these general terms and conditions. The submission of the purchase order implies their full knowledge and acceptance. Finally, the customer is obliged, once the online purchase procedure is concluded, to print and keep these general contract conditions, already viewed and accepted during the conclusion phase of the contract.
5) Purchase procedure
The buyer purchases the product, whose characteristics are illustrated in the relative descriptive and technical sheets on the website www.fantasticoptik.com, at the price indicated. Once the purchase order has been submitted, the customer will receive an e-mail confirming receipt of the order and containing information on the main features of the goods purchased, detailed indication of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general terms and conditions.
The consumer can make the payment due, in advance of the shipment, choosing one of the following methods listed.
- Bank transfer
Payment by bank transfer. In the event that the payment is made by bank transfer, the purchased good will be sent to the address indicated by the consumer upon receipt of the bank accountant, then on average five days after making the transfer. After making the bank transfer, send the payment receipt together with your order number to the email address from which you received the summary.
- Credit card
Payment by credit card through the PayPal circuit. After sending the summary we do not accept changes in payment methods.
7) Delivery of products
The purchased good, together with the relative invoice, is delivered by express courier. The delivery of the goods, if in stock, is guaranteed within a minimum of 7 days and a maximum of 10 days from receipt of payment, unless the customer has chosen the method of payment by bank transfer pursuant to art. 6, letter a of the present contract. In the case of non-delivery due to the absence of the recipient, to the address indicated in the order, the courier will leave a notice with instructions to follow, and / or try again a second time and / or email will be notified by Fantastic Optik; if the recipient is still absent or does not collect the goods where indicated by the deadline, the goods will be placed in storage and in case of additional charges will be charged to the buyer. Fantastic Optik provides the manufacturer’s warranty (limited warranty) that covers any defects in the manufacture of products for 12 months from the date of purchase, this date must be confirmed by a proof of purchase of the product and / or warranty certificate (where present) duly completed. Manufacturing defects (of materials or workmanship) related to sunglasses and prescription frames, with the exception of the following non-covering cases: prescription lenses, scratches on the lenses of sunglasses, defects due to accidents, abuse , negligence, impact, improper use or storage of the product, unauthorized modifications or repairs, normal wear and tear. Once the Fantastic Optik has confirmed the presence of a manufacturing defect, depending on the problem, the frame or the defective part in question will be repaired, replaced or refunded.
9) applicable law and jurisdiction
This contract is regulated by the Italian law. Any dispute concerning the stipulation, interpretation, execution or termination of this contract will be subject to the exclusive jurisdiction of the judge of the place of residence or domicile of Fantastic Optik srl.
For anything not expressly provided for in this contract, the provisions of Italian law in force apply.
